Handout 11.1 Sentencing: Values and Beliefs

Please enter your response to the handout 11.1 here. Select one of the controversial issues regarding sentencing in Canadian society and respond with a 300 word response. Find support for the position you select however I would like this be your viewpoint with some support you have found via research….not the viewpoint of a website with a little of your viewpoint!

Criminal Law: Reasonable Doubt & Home Searches

Response to be completed by Thursday May 3,2012 at 11:59pm.Part A   Guilty beyond a reasonable doubt“It is better to let 10 guilty people go free than have 1 innocent person wrongly convicted.”

The following quote has been used by some legal experts  to describe our criminal trial process and the concepts of burden of proof, innocent until proven guilty beyond a reasonable doubt.

I would like you to respond with your thoughts/opinions on the above quote and the standard for Canada’s burden of proof. Do you agree or disagree? Based on this quote, guilty individuals get away with crimes because the standard of proof is so high. Should evidence be required to be so convincing in Canadian courts? Why or Why not?

 

Part B Searching a Place

Police officers who do not have a warrant can search a residence with the homeowner’s permission.

Discuss whether police officers should have the right to search your room without your permission, even if they have your parents permission to search the residence. Fair or foul? Explain.

What really happens in such situations in Canada? Can the police in Canada do this?

 

Canadian Charter of Rights and Freedoms

As we have learned in class our Canadian Charter of Rights and Freedoms are part of the constitution…thus making them guaranteed. Suppose Canada was invaded by a foreign country. You are given the choice of  keeping only 3 rights or freedoms from the Charter. All others would be lost and would no longer apply to the people of Canada. Which three rights or freedoms would you want to keep? (you view these three as the most important). Explain your reason for selecting each of your choices. Rank your selections in the form of a countdown from #3 to #1 with #1 being the most important in your opinion.

Philosophy on Justice

Students responses are due by 11:59 pm on February 23, 2012.

In class, you have learned about retribution and restitution. For this blog response you are asked to do the following:

a) explain your understanding of retribution and restitution

b) State which one you think is better and is more effective in today’s world and explain why.

c) find a news story from the last 6 months that demonstrates retribution and another article that demonstrates restitution. Briefly summarize each article and the news source.

Laws and Morality

Students must respond to this blog post by 11:59pm on February 23, 2012 .
Most laws reflect the moral values of the majority in a society. Laws based on morality suggest the values, attitudes, and beliefs that Canadian citizens hold in common. In some cases, the law and moral standards can be in conflict for members of a society (controversy!). Individuals/groups who do not share these values are free to speak out publicly and try to change the law.

- You are to select an issue that demonstrates how law and morals can be in conflict (past or present issue).  Use facts as well as persuasive writing to present a position/side on your selected topic/issue.

Discussion forum: how it works…

A course requirement is participation in a discussion forum.  A question or article will be posted on the discussion forum which will require your response.. You will have until 11:59 pm the following week to complete your response. Responses are usually 200 words. Students are required to complete responses on their own time, although some lab time will be provided for completion of activities and discussion responses.
